Just like in real life, if someone shout a racist statement in the middle of the sidewalk and you are within earshot, you hear it.
Relays could choose to edit what notes they accept, but just like email, anyone can send anything into the protocol.
I'm not saying that I like / approve / enjoy racism, but people post racist notes on Nostr and you can choose to engage / follow them or not.
