Im Übrigen hat der BFH bereits mehrfach entschieden, dass das allgemeine Risiko eines sogenannten "Hacker-Angriffs" im überwiegenden Interesse des Gemeinwohls hinzunehmen ist (BFH-Urteil vom 15.05.2018 - VII R 14/17, Rz 22, m.w.N.).

"Im milliardenschweren Steuerskandal um Cum-Ex-Aktiengeschäfte ist das nächste Urteil gefallen. Das LG Frankfurt am Main verhängte am Dienstag eine Haftstrafe von drei Jahren und sechs Monaten gegen einen früheren Top-Anwalt der Großkanzlei Freshfields Bruckhaus Deringer.
Das Gericht sah es als erwiesen an, dass der Mann Beihilfe zu schwerer Steuerhinterziehung in vier Fällen geleistet hat. (Urteil vom 30.01.2024 - 5/24 KLs 7480 Js 208433/21 (2/21)). Damit wurde erstmals ein Steueranwalt einer Großkanzlei für seine Beraterrolle im Cum-Ex-Komplex strafrechtlich belangt. Neben dem früheren Freshfields-Spitzenjuristen wurde ein ehemaliger Maple-Banker verurteilt. Er bekam zwei Jahre Haft auf Bewährung wegen Steuerhinterziehung, nachdem er bereits zum Prozessauftakt ein Geständnis abgelegt hatte.
Der frühere Anwalt hatte die Maple Bank zu Cum-Ex-Deals beraten. Freshfields erstellte Gutachten über die steuerliche Zulässigkeit der Aktien-Deals. Die Generalstaatsanwaltschaft Frankfurt hatte dem Steuerrechtler vorgeworfen, er habe mit "Gefälligkeitsgutachten" die Täuschung des Fiskus mit ermöglicht. Die Maple Bank verursachte mit Cum-Ex-Geschäften laut Anklage einen Steuerschaden von rund 388 Millionen Euro - bis sie 2016 selbst in die Pleite stürzte, weil wegen einer Steuerrückstellung zu Cum-Ex-Geschäften die Überschuldung drohte.
Bei Cum-Ex-Deals, die ihre Hochphase zwischen 2006 und 2011 hatten, ließen sich Investoren nie gezahlte Kapitalertragsteuern erstatten und prellten den Staat geschätzt um mindestens zehn Milliarden Euro. Dabei nutzten sie eine Gesetzeslücke. Erst im Jahr 2012 wurde das Schlupfloch geschlossen. 2021 entschied der Bundesgerichtshof, dass Cum-Ex-Geschäfte als Steuerhinterziehung zu werten sind.

Ja, klar, die Öffentlichkeit kommt scharenweise ins Gericht, um sich dann in einen Saal zu setzen, in dem ein Monitor zu sehen ist, auf dem wiederum drei Monitore zu sehen sind, nämlich von beiden Anwälten und vom Vorsitzenden Richter - alle aus dem Homeoffice miteinander verbunden.
Dann kann doch eigentlich die Öffentlichkeit auch zu Hause bleiben ... und zugeschaltet werden, oder ?
Das merkt der Gesetzgeber dann später und macht ... noch einen Gesetzesentwurf. Ganz sicher.

Auch, wenn er Rechtsmittel einlegen möchte.
Wenn er auch nur ein Häkchen falsch setzt, kommt er nicht weiter. No way.
Und er muss die Logik der Menschen verstehen, die sich dieses Formular in all den Abhängigkeiten ausgedacht haben.
Beispiel: Rechtsmittel gegen einen Bescheid einlegen - gefühlt 30 Felder, in denen der Bürger hängen bleiben kann. Ein Feld mit der Aufschrift "Jahr". Er trägt ein Jahr ein, weil der Bescheid dieses Jahr betrifft. Und dann kommt das hier:

Im Anwaltsbereich nennt das der Gesetzgeber

What a BTC-related start-up could possibly do in this situation is to open a small Ltd. in Germany (called UG, kind of a small GmbH), define in the set-up-process what exactly the business area should be and then open a bank account in Germany. As the deposit of the share capital, required by law, is done by bank transfer, a bank account in Germany (some German or EU-bank, based in Germany) is not only paramount, but essential. If the tax authorities involved in the set-up gave their o.k., there is always a bank to contract with for an account.

Bisher - Stand: Ende Februar 2023 - hat das Bundesverfassungsgericht nicht über die A-Besoldung entschieden.
Es ist hier nicht bekannt, wann das Gericht über die Vorlagebeschlüsse des Bundesverwaltungsgerichts und des Oberverwaltungsgerichts entscheiden wird.
Die Verfahren vor dem Verwaltungsgericht Berlin wurden bis zu einer Entscheidung des Bundesverfassungsgerichts ausgesetzt und werden erst nach der Entscheidung wieder aufgenommen.
Die Widerspruchsverfahren ruhen nach Auskunft des Justiziariats der Polizei Berlin entsprechend der Hinweise der Senatsverwaltung für Finanzen im Rundschreiben IV vom 14. April 2021. Um Missverständnissen vorzubeugen, weist die Behörde weiter darauf hin, dass die rechtzeitige Erhebung eines Widerspruchs, der noch nicht bestandskräftig beschieden worden ist, zur Anspruchswahrung ausreicht.
Wichtig ist die Einreichung eines weiteren Widerspruchs auf jeden Fall nach einer Beförderung.
