The 8/28 hearing transcripts were released. Judge was furious with me because he thought I was intentionally repeatedly interrupting him (I couldn't hear him & the video froze so I didn't know he was speaking). That's mortifying. 😱
Otherwise I mostly made all my key arguments. 😓
Also, transcripts showed Courtroom could not hear me several times, & multiple times I did not hear the Judge. Two sus Twitter accounts had immediately tried to convince me there were no internet connection issues. 🥴

This tool is really cool. You can search your documents like you're searching the internet for webpages, then you can tag them all like you're annotating data for ML. I can't even imagine how fancy the big firm tools are.

Apple's still dicking around about discovery & so far hasn't given me a single thing I've asked for.
So I just kept at it with public records requests & now tonight I'm sitting in front of a giant poster I printed of the detailed specs for Apple's mechanical exhaust at their fab.
Note: If you know how to read these types of docs, please give me a holler. Mechanical engineering is fairly new to me.

Following the US Judge's order for a discovery referee, a Magistrate Judge was assigned to oversee discovery in my case (through a random assignment process).
Prior to becoming a Judge, she worked as a city attorney for Oakland - where she prosecuted, among other things, code enforcement and nuisance abatement cases. 😎

The US Judge in my civil case just issued an order assigning a Magistrate Judge to oversee discovery. It sounds like the discovery Judge will also project manage us.
Now Apple will have to actually participate, & will have to stop stonewalling.

The hearing went well! The Judge will file a Case Scheduling Order with details, but high level for now:
- We're starting discovery even though Apple doesn't want to;
- He's assigning a Magistrate Judge to oversee all of our discovery (🤩!!!);
- The trial will be scheduled despite Apple's protest

In 1996 the CEO of a semiconductor fab facility on Scott Blvd (near where Apple's fab is now) bought a full page ad in the Mercury News to protest putting schools / daycares next to fab; explaining that fab has "dangerous chemicals in constant use" & pleads that children should be no where near it.

On Monday, Apple & I were supposed to have Part 2 of civil 26f meet/confer.
The first meet/confer I actually agreed to talk to their lawyers without a transcript or witness.

TLDR; EPA discovered that Apple was:
- illegally treating hazardous waste
- illegally transporting hazardous waste to disposal facilities
- illegally dumping hazardous waste into the ambient air outside the facility (into the apartment windows)
- leaving stockpiles of extremely dangerous chemicals unattended on weekends

US EPA Enforcement & Compliance conducted 3 onsite inspections of Apple's fab facility in 8/2023 + 1/2024. US EPA noted at least *19* potential violations of the RCRA hazardous waste statute.

🧵 In 2020, I nearly died from mysterious industrial chemical exposure at my apartment. Later, in 2023, I discovered my employer was dumping toxic waste into the apartment windows from their Skunkworks semiconductor fab next-door. I tipped off the US EPA, who sent their env cops to raid Apple's plant in Aug of 2023. The US EPA finally released the report of their enforcement inspections & sent me a copy on Friday. 💀 ⬇️

My latest civil amended complaint is now filed! The judge allowed me to try to re-add a bunch of claims after the motion to dismiss, but I realized I already have too many claims, so I surrendered the majority of the claims he dismissed. I think 12 claims is enough! Let's go!!💀

The hotter the planet gets, the more water & electricity are required to run data centers. Using unnecessary cloud tech during heat waves means less water for humans to drink to stay alive during heat waves. Continuing to consume will make heat waves more common & severe.

US EPA just announced a proposed rule that would formally ban most uses of the chemical N-Methyl-2-pyrrolidone (NMP) under the Toxic Substances Control Act due to the chemical causing "serious health effects."

I just filed my proposed Amended Complaint in the environmental whistleblower DOL case. I was able to merge all the toxic dump (CERCLA) & dumping (RCRA, Clean Air Act, TSCA) complaints, & I incorporated facts from Apple's surprise discovery docs. I apologized to DOL its hours late but explained Apple made me very sad.

Remember that Apple Employee Retaliations investigator who inexplicitly showed up at my Superfund meetings with EH&S in April 2021?
& now we know it was because she was already investigating me for talking about workplace safety after my boss 'reported' me in March 2021?

Something powerful happened to me after the favorable legal decisions last week. My brain exploded for a few days trying to acknowledge what happened (finally!!!) but then I woke up & I felt like myself again, before all of this happened. I was still there & I'm back!
The git-merge failed terribly, but now feels more like I restored from an old backup & transferred over the delta of files from an external hard drive.
I don't know how to explain it better than that - it's very weird and good.

This week may be as exciting as last week!
The US EPA Enforcement team confirmed to me they finalized a report of their findings from the RCRA (haz waste) inspections of Apple's silicon fab shop that nearly killed me in 2020.
(the inspections were due to my whistleblower tips & complaints)
Apple claimed some of the inspection details are confidential, so I'm waiting on a redacted copy - but it should be very soon now.

I started having dizzy spells again a couple weeks ago & apparently I've lost so much weight this year my blood pressure corrected itself & now the high-dose blood pressure meds are knocking me over. My doctor's getting me off them now. Feeling very excited to get healthy again.
Apparently you can reduce your blood pressure 5-20 mmHg with 20 pounds of weight loss. I've lost 30 pounds this year and I think I'm gonna need a chaise lounge on stand-by until I can get off this Lisinopril.

I'm still very overwhelmed and emotional about actually having fair adjudications & the progress made...

The US Judge just issued a 49 page decision in Gjovik v Apple, dismissing some of my claims with prejudice (SOX & Dodd Frank), and some without prejudice and leave to amend (RICO, Bane, Ralph), and preserving many others. I'm reading it now. 👀

I owe you guys more updates about the Gjovik v #Apple hearing on Thursday, but I've been so overwhelmed with emotion the last couple days; I've been kinda speechless.
I'll probably have to write a blog post about it to properly convey what it feels like to do something impossible like this & actually have it go in your favor.
I'll also share the audio recording when its posted (prob next week). The formal decision is prob 2-3 weeks out still, but I'm feeling good.

I think the hearing today went very well.
Best case scenario was I keep all my claims; worst case was I only keep the 4 claims Apple's not fighting - but sounds like the outcome will be right in the middle ground, which is great news. I'm very happy!
When they're released, I'll share the transcripts & decision!

The #NLRB Board just affirmed the ALJ's decision in favor of the WTC #Apple workers (based on their May 2022 unfair labor practice charge); with the Board issuing a new decision against Apple today.
This is freaking huge. So proud of my ex-colleagues!!! 🎉🎉🎉

I've been working on my US Dept of Labor filings for a few days straight now. My back & neck hurts. I got only 2hrs of sleep last night. My eyes are burning.

Since Dec. 2020, OSHA tossed 25 of 27 now closed whistleblower claims against Boeing.

I read Apple's motion to try to dismiss my Dept of Labor Superfund whistleblower case. Apple's primary arguments are 1) #Superfund laws don't apply to #Apple & 2) strawman arguments about the CERCLA status of the Apple office that Apple'd actually lose if they were real arguments.
Apple's defense strategy is still the same: completely ignore all of the facts in my complaints; create their own farcical narrative of what happened, ignoring the evidence; & Apple repeatedly implied that I'm insane.

I had a very bad headache from so many all-nighters, so I still haven't read all the wild things Apple filed; which will give me new headaches.
Instead of going on that journey last night, I re-read my Complaint.
I did a great job (other than typos 💀 ). All of Apple's thrashing right now is because I did a great job.

Apple's facing a civil RICO charge from me accusing them of tampering with a federal witness / informant / victim.
I complained Apple kept intimidating & threatening me to try to get me to drop my federal charges against them.

I'm feeling very proud of successfully litigating against Apple the megacorp as my own lawyer. I've done exceptionally well so far, considering the resources they have. It's a huge feat.
I've been reflecting about it - and I think my autism has helped a lot. They try to do all sorts of weird stuff to me that does not interest me at all.
A personality test once called me a "talkative little calculator." I felt seen.
