He's overseeing an X Corp. lawsuit. He invests in Tesla, he's used to invest in Twitter, and he invests in a company with a longtime relationship with Musk that also invests in X Corp. And yet, he's still overseeing X Corp.'s lawsuit against Media Matters.

I can't get over this. Reed O'Connor found personal jurisdiction because two companies that X Corp. wanted to keep as advertisers are based in Texas.
(Those companies are not parties in this litigation, on either side, lest you think I'm missing something obvious.)

O'Connor doesn't ignore that case, not exactly. Instead, he finds personal jurisdiction because two of the Twitter/X advertisers mentioned are headquartered in Texas. That is "targeting ... sufficient to establish specific jurisdiction in Texas."

Jack Smith added "private" to all of the co-conspirators, to highlight their clearly non-official roles — and got rid of Jeffrey Clark, the DOJ guy who was willing to be acting AG and pursue Trump's fake election fraud claims if Trump let him.

Back to the majority: After having admitted the law is more broad than others—but still staying the district ct's injunction pending appeal—the majority ALSO tries to SCOTUS-proof it by highlighting that they're setting this for a quick appeal (a factor in the Title IX order).

In Eknes-Tucker, allowing Alabama's ban to go into effect, the 11th Circuit noted the trial court there had not found the law was based on invidious discrimination.
Here, Grant and Luck treat it like that's a loophole that the district court used in considering Florida's law.

This is an appalling, dismissive order from Judges Britt Grant and Robert Luck. (Wilson dissented. Again.)
I still think a judge issuing an order restricting people's rights—and, in practice, overturning a district court judge—should have the temerity to put their name on it.
