on 4th Sept 2024 #ChatControl regulation representatives of EU goverments will resume work based on a secret document according to Patrick #Breyer, former Member of the European Parliament.
Help to mobilize everybody to defend our #privacy of communication and its developers, investors!
If no preventive actions from your side now, this regulation will be endorsed on 12/13 December 2024.
According to the draft regulation dated 28 May (Council document 9093/24), ChatControl deploys to do, for instance:
🔻 “upload moderation”, users of apps and services with chat functions are to be asked whether they accept the indiscriminate and error-prone scanning and possibly reporting of their privately shared images, photos and videos.
🔻Scan by “artificial intelligence” technology previously unknown images and videos;
🔻If a user refuses the scanning, they would be blocked from sending or receiving images, photos, videos and links (Article 10).
🔻End-to-end encrypted services such as Whatsapp or Signal would have to implement the automated searches “prior to transmission” of a message (so-called client-side scanning, Article 10a).
During the last discussion on 24 May, the Council Legal Service made it clear that indiscriminate chat control scanning of non-suspects is still envisioned and remains a violation of fundamental rights.

I had the honour of sharing my personal experience with Melanion Capital & Jad #Comair on their podcast about how easy it is to weaponise the financial data of every resident and citizen of Western countries.
The refusal to protect banking secrecy has led to a massive failure in the protection of human rights. #Bitcoin p2p transactions have become the only available tool for the financially repressed and excluded as a consequence of the abuse of AML/CFT laws.
We live in a time when financial institutions have been given the right to police activities of citizens. If your rights are violated by the police, you have the possibility of defence/remedies. However, with financial institutions, there are no such mechanisms due to Financial Action Task Force (FATF) recommendations.
I experienced this first hand when three authoritarian regimes abused my and Open Dialogue Foundation banking data getting it from #Belgium and #Poland.
Banking records obtained by three regimes became a weapon against me and anyone who worked, received our support in different countries or championed our human rights work at the time. I able to continue my human rights work and hold accountable perpetrators of violations of my rights thanks to #freedomtech Bitcoin.
Ironically, AML/CFT laws were created to fight criminals, oligarchs, dictators corrupting western countries. In reality - AML/CFT laws have become the most effective tool for #TransnationalRepression, breaking down all barriers to protect the right to #privacy of #correspondence, #transactions, #movements. If you think that this only applies to dictatorial or authoritarian countries, you are sorely mistaken.

I truly believe it is a huge mistake and misunderstanding of the consequences.
Everyone who said in the past - let’s do not care about human rights, how bad regulations affects human rights and just move to other jurisdictions at the end of their experience understood - regimes able to reach them in the every place in the world.
Same here: Norwegian regulatory standards will be used as an example for the EU single market, through OECD globally. To prove it more context - Swedish government implemented what Norway is doing right now. So what is the result? Sweden is pushing restrictive regulations against bitcoin mining at the EU level.
#Bitcoin is the same human right as others, it is people behind the technology, its developers, investors, miners and end-users. Bitcoin is not getting funds from the authoritarian world, simply because it is a threat to dictatorship by default. So why you should allow to restrict it while you have all privileges to impact your regulators and change their approach?
It is a matter of responsibility, investment of your time and resources, just like US bitcoin community is doing, and achieving significant success. Without just being complaining or being ignorant.

It doesn’t work who is the most influential. It works when majority of community will activate local communities and educate them, will contact to legislators and regulators with requests to include their opinions during regulatory process, effectively convincing them to be on bitcoin mining side. It sounds probably abstract, but look at the US - bitcoin community investing there its time, resources and getting results. Why we in the EU/EEA can’t do the same?

We were asking about public consultations on that issue - it is a part of the regulatory process. We got an answer that they don’t have any plans to conduct such consultations.
My post about that - no public consultation while preparing governmental report on the ban of mining cryptocurrencies.
The fact that parliament will discuss publicly already written negative report of the government, without input of industry and end-users, doesn’t give you much.

Norway's Ministry of Digitalisation and Public Administration responded to @ODFoundation that it "has no plans to conduct a public consultation" on a ban on cryptocurrency mining.

(1) Norway is fully integrated in the European Single Market throught the European Economic Area (EEA) and Schengen Agreement. It means Norway can provide its legilsative approach as an input for new legislation for the EU/EEA both:
- during the preparatory phase, when the @EU_Commission is developing proposals;
- during work of expert groups and committees of the European Commission;
- submitting proposals and comments to European Free Trade Association on upcoming legislation.
(2) As a co-founder of the @OECD , Norway sets an example of regulation worldwide and provides its legislative recommedations for global standards.
(3) Norway has historically been a place to meet, share experiences and educate human rights defenders and bitcoiners from around the world.
Norwegian goverment will present its investigation a ban on cryptocurrency mining by the end of 2024.

🚨 WHAT ENABLES DICTATORS TO KILL?

On 18 June 2024 in #Kyiv, the Tokayev-Nazarbayev regime organised the assassination of Aydos #Sadykov, a Kazakhstani opposition journalist and political refugee in #Ukraine. The shooter executed the journalist's head in front of his wife as they drove up to the courtyard of their flat during daylight hours.

Sadykov's wife immediately named the one who ordered the political murder - the president of Kazakhstan Tokayev.
Sadykova noted that the family had received regular threats on their lives for criticising Tokayev. On the eve of the assassination, Sadykov released a video statement where he called Tokayev a "puppet of #Putin."
What is #Tokayev doing?
The very next day, fearing international accountability, Tokayev issued a statement "that the priority in the country is the rule of law".

It is crucial to remind why Tokayev should not be believed. Politics is a world of perceptions. Tokayev understands this well and knows in practice that #propaganda has already helped him escape accountability:

- for the torture, mass shootings and arbitrary arrests of more than 10,000 peaceful protesters in January 2022;
⠀
- for helping #Russia circumvent international sanctions for 2.5 years;
⠀
- for weaponising the #banking system, anti-money laundering and anti-terrorism laws as a tool to financially exclude critics of the regime domestically and #transnationally;
⠀
- for political persecution through INTERPOL, extraditions, and influencing justice and asylum authorities in Western countries, including the attempted kidnapping of Bota Jardemalie from #Belgium, the hunt by killers for Mukhtar #Ablyazov in #France, and other cases of transnational persecution of opposition and human rights defenders.
It is important to remind that Tokayev's regime gained access to Interpol's databases in December 2023 through a "silver notification". But regime of Tokayev is using not to combat with criminals, but to have just another tool to dispatch killers to an address anywhere in the world with jewellery precision against critics.

This arbitrariness should be halted. I share this post on #Nostr because the most probably on other social media platforms it will be removed following multiple attacks and demands of Kazakhstani ministry of justice.

We Have to Defend Bitcoin Mining in Norway. Here is why:
1/4 In April 2024, the Norwegian government introduced a legislation to regulate data centers in a way that effectively bans #Bitcoin mining in the country.

One more proof: the banking system is the best tool for money laundering or evade sanctions by those in power in dictatorial countries. Dictators don't need #Bitcoin wallets or mixers, they prefer banks, and better for them if it is western banks.
For some reason, the current AML/CFT rules do not work to prevent such cases. Will #Raiffeisen Bank be held accountable by #SDNY, #ECB and #FATF?

Since US law enforcement agencies have been able to identify a money laundering offence involving this particular wallet, then they are well equipped to detect such crimes, and there is no need to criminalise mixers or #bitcoin wallets as a technology and its developers in general.
This is exactly what we talk about in our meetings with regulators: we understand that US law enforcement has all the tools to track #Bitcoin transactions on the blockchain. That is why real criminals, and even more so oligarchs, use completely different schemes to launder dirty money.

Moreover, the knowledge of US intelligence agencies is used to financially exclude regime critics and their family members both domestically and transnationally. This is exactly what #Turkey, #Kazakhstan and other regimes do all the time, sharing knowledge gained from Western partners with #Russia, #Iran, #China to repress dissenters abroad.
In less than 5 minutes Kazakhstan blocks fundraising via bank account or @stripe for families of political prisoners, so bitcoin p2p transactions and mixers are currently the only instrument to protect human rights in such authoritarian countries. Regimes can trace such transactions, but they can't stop them and so far it has helped save lives.

Regimes can trace such transactions, but they can't stop them and so far it has helped save lives.
Therefore, we will continue to defend mixers and self-hosted wallets, and draw the attention of the U.S. and other G7 countries to how in reality the banking systems of third countries like Kazakhstan, Kyrgyzstan, and Turkey are used to circumvent Russian sanctions to the extent of hundreds of billions of U.S. dollars and remain unpunished due to abuse of power domestically and abuse AML/CFT laws transnationally.

3. #EU #AML PROPOSAL TARGETS PRIVACY PAYMENT INSTRUMENTS AND FREEDOM TOOLS
The current AMLR version specifically targets self-hosted wallets, ignoring their role as vital financial tools as #Bitcoin for millions of activists facing financial oppression.
Labeled high-risk, self-hosted wallets are now seen as significant money laundering and terrorist financing facilitators. Changes include revisions to Recitals (20) and (21) and the addition of Article (31b) in Charter III, which increases operational and compliance costs, affecting business strategies and client relationships.
The consequences for EU users of self-hosted wallets are serious. Additional compliance checks will complicate, if not block, the conversion of crypto-assets to fiat currency for activists and civil society members already facing financial exclusion. The AMLR overlooks the crucial role of self-hosted wallets in transferring funds to non-democratic or conflict regions, exposing donors and recipients to repression by authoritarian regimes using AML/CFT laws (e.g., in #Belarus, #Kazakhstan, #Turkey).
Smaller clients with self-hosted wallets, viewed as higher risks under Article (31b), may be deprioritized or excluded due to higher transaction compliance costs. This makes them economically unviable for financial institutions, which often favor larger, lower-risk clients for efficiency. The latest AMLR version could effectively ban self-hosted wallets in the EU, significantly impacting the cryptocurrency sector and those vulnerable to oppression.

In the post-Trialogue version of AMLR proposal Article (41a) “Unwarranted de-risking, non-discrimination and financial inclusion” was deleted.
It was introduced by the European Parliament in 2023 as a result of the #BTC Coalition's human rights advocacy campaign - our testimonials about the financial exclusion in the EU as a result of transnational repression organised by the authoritarian regimes.

It is very easy to violate the rights when no one is trying to oppose.
It is easy to ban #PoW in the #EU, develop very discriminatory language in policies since just a few bitcoin miners ready to defend themselves and meet with regulators.

There are many draconial provisions in the upcoming #EU #AML Regulation both for cash and to p2p #bitcoin transactions (self-hosted wallets and use of mixers).
Some examples:
(33b) The introduction of a Union-wide limit to large cash payment mitigates the risks associated with the use of large cash payments. However, obliged entities that carry out transactions in cash below this amount remain vulnerable to risks of money laundering and terrorist financing as they provide a point of entry into the Union’s financial system. Therefore, it is necessary to require the application of customer due diligence measures to mitigate the risks of misuse of cash. To ensure that the measures are proportionate with the risks posed by transactions of a value lower than EUR 10 000, such measures should be limited to the identification and verification of the customer and the beneficial owner when carrying out occasional transactions in cash of at least EUR 3 000. This provision does not relieve the obliged entity from conducting all customer due diligence measures whenever there is a suspicion of money laundering or terrorist financing, or from reporting suspicious transactions to the FIU.
(93) The anonymity of crypto-assets exposes them to risks of misuse for criminal purposes. Anonymous crypto-asset ▌accounts as well as other anonymising instruments, do not allow the traceability of crypto-asset transfers, whilst also making it difficult to identify linked transactions that may raise suspicion or to apply to adequate level of customer due diligence. In order to ensure effective application of AML/CFT requirements to crypto-assets, it is necessary to prohibit the provision and the custody of anonymous crypto-asset ▌accounts or accounts allowing for the anonymisation or the increased obfuscation of transactions by crypto-asset service providers, including through anonymity-enhancing coins. The prohibition does not apply to providers of hardware and software or providers of self-hosted wallets insofar as they do not possess access to or control over those crypto-assets wallets.
As we were said by the EU Commission, “the ban on crypto-asset payments not intermediated by a crypto-asset service provider has not been retained given the absence of technical means of enforcing such a requirement at present”. But that exactly shows the direction of the regulatory approach.
This is a huge deterioration of financial and privacy rights after EU Commission and Council put pressure on the EU Parliament and removed all provisions in favor for individual rights, privacy and financial inclusion.

REGIMES' WAR AGAINST P2P BITCOIN CASH EXCHANGES HAS BEGUN
Imagine you were born in one of the richest countries in the world, with an area as big as the entire territory of the European Union. All the wealth is in the hands of a narrow group of corrupt oligarchs, while the population of the country simply survives on food loans.
This is what #Kazakhstan looks like today, where the regime is kept in place only through brutal repression and Putin's army, ready to crush peaceful protests at the first call of the Kazakh president.
As soon as you dare to put a like under a post criticising the authorities or participate in a protest, you are declared an extremist, a terrorist, a threat to national security or a money launderer.
The police will not only torture you to death after your arrest, they always take hostages of those you care about most. Your son or daughter may be kidnapped and killed to "make you come to your senses".
Your only chance of escape is to get on EU or US politicians' political prisoner lists. Kazakhstan is very keen on international recognition, trade and these are the only leverages for the release of political prisoners.
But let's look at another situation. You are not an activist. You're just a sympathiser and you've decided to donate to support the politically persecuted or support an opposition movement.
🔻What then? You'll be charged with „funding extremism” or „laundering money” in a secret court. You, your family members will all be financially excluded immediately. You can work informally for cash, but it is becoming increasingly difficult.
In such situations as described above, p2p exchange of cash for #bitcoin becomes the only salvation for you, how to protect your resources from illegal searches by secret police, banal theft and in general safety, transfer of your value.
🔻But the party did not last long: Kazakhstan's regime decided to take the tool away from the financially excluded and criminalise p2p cash-to-cryptocurrency exchanges in line with FATF/G7 recommendations.
Protecting such people as politically repressed is almost impossible for human rights defenders with this approach. This is one of the main factors why negative language towards bitcoin/p2p exchanges should not be allowed in the regulation of democracies.
🔻Kazakhstan primarily targeting those who use p2p transactions, mostly with cash for bitcoin and #USDT. On 12 March 2024, Kazakhstani media reported that a resident of Astana was imprisoned for 2 years and 6 months with confiscation of property for "illegal p2p-exchange of cash for cryptocurrency".
🔻Follow how fast was reaction of regime: on 4 March 2024, the Financial Monitoring Agency of Kazakhstan announced that it "observes the presence of illegal transactions of individuals with cryptocurrency (purchase, sale, payments for goods, works, services, transactions via P2P)".
Already on 12 March, the first demonstrative "verdict" on conducting "illegal" p2p exchanges of cash for cryptocurrency was announced.

Enjoying the moments of my life:
❤️‍🔥 A moment of weakness: the hardest memories in my 15 years of human rights work are the meetings of families with released political prisoners.
I thought that after having had over 100 such meetings, I could be less emotional.
I can't. An image from my childhood of first losing hope from the lawlessness of the regime towards my family, and then the endless joy of being able to hug my brother, who was released after being kidnapped from the hospital, comes back to me every time.
But every time you feel a wave of joy at the happiness in the eyes of family members in hugs with their loved ones, your pain disappear. You witness the steely hurt in the eyes, the facial expressions from reliving the nightmares of the political prisoners who were released. You see the love that sustained them and helped them through this journey. That moments move you forward and stimulate your work when others disbelieve that it’s possible. Everything is possible.
🧡A moment of strength: I remember vividly the losses, the experienced ups full of love and the painful downs on the way to 39 years. Our love, our feelings and beliefs are getting stronger when we experienced ups and downs, when we fight for our beloved.
I remember the realisation of the moment, how life can be cut short in a matter of days. Everyone you love and everything you love can be shattered. What remains is the memory and the belief that you can overcome, you will love again. You used to say it to other politically repressed who had such experience, and than that moment came to you… you have to listen no matter how hard it was to say.
⚡️Importance of learning: You learn fast how important it is to live in the moment and how important it is to be able to first defeat your own consciousness and the minds of those around you, then the winning in the physical world is a matter of technique. Then comes the moment of power, not only yours but those who are with you in this struggle.
6 years later with this approach you can not only stop but defeat two of the three authoritarian regimes using the whole machinery of power against you and your family, your organisation.
🫶 How to fight back: Yep, it's possible. I have been able to walk this path because of my experience in defending the politically persecuted, friends, my brother who know how to share not only moments of joy but also how to hold a strike. Being all financially isolated, we were able to resist and defeat the attacks of the three regimes thanks to #bitcoin.
#SatoshiNakomoto is unlikely to read this post, but that doesn't mean I want to give him a huge thank you. For being able to stand up, to save the lives of those for whom human rights are not just a set of derring-do phrases and "fresh regret".

It is all about privileges and instruments you have in your hands to defend your life, close to your people, or your peaceful environment, home where do you live. If you don’t defend them, but enjoy your freedoms - it means someone did this job for you.
My 15 years of experience in human rights gave me painful lessons that all freedoms have to be defended or better to be preserved from abuse, and reality doesn’t care if you admit it or not.
In democracies you have more chances to defend/preserve your freedoms in easier and safe way. In case of political prisoners or victims of torture of dictatorships - political pressure of democratic institutions is the only chance to save imprisoned activist’s lives.
In dictatorships even like of the post in social media can cost you a life. Same can happen with bitcoin, especially if democracies label it in the regulations with criminal activities.
#bitcoin as a technology doesn’t need me or you. But it was created by freedom fighter Satoshi #Nakamoto to support freedom fighters. In solidarity I don’t want to allow to some lazy privileged individuals in democratic countries to ban/label #bitcoin or #PoW with any illicit activities/threat to security at the early stage of its existence.
In democracies I can safely explain to regulators that it is an enormous mistake of privileged people, who don’t know what is financial exclusion in practice and forget that technology is always should be evaluated as a neutral tool. It can be used by bad and good actors. But it doesn’t mean that legitimate actors should suffer.
And those whom I met from regulators agreed with me and our recommendations, both in US and EU. That is why I want to continue my work in defense of neutral language to bitcoin and PoW as technology in democracies.
I cannot do this in authoritarian states.
I experienced what does it mean being financially excluded due to coordinated attacks of three dictators in the very heart of EU, in Brussels. Also just as my colleagues activists in dictatorships - we need both bitcoin as the only financial tool we have rights now and both political support of democratic governments who help us to release political prisoners.

I guess they have an agenda. But the problem is that there is almost no voices to oppose them from the industry. Just to be vocal in tweets it is not enough. More effective in a long term to educate politicians so all upcoming regulations don’t harm us. We can’t play the game “I don’t care”. Do we want or not, we are going to ask democracies to help us release political prisoners in the authoritarian states. We do so for over 14 years for now. So I want to be able to defend both my activists suffering from repressions and help them use bitcoin without labeling it “environmentally unsustainable” or “threat to financial integrity” in G7 countries.
It is not an abstract issue. We did it with @npub1kp7…487l who is literally our angel 👼, patiently attending almost all meetings we organized. But he can’t do all alone. We need faces/testimonials and participation of bitcoin miners in the meetings too in defense of PoW.

It is sad that EU regulators and public opinion are listening to #Greenpeace. This should be exposed properly.
If you are a #Bitcoin miner, don’t abandon this propaganda. Help us, end-users and human rights activists to defend bitcoin on the ongoing attack on PoW in the #EU.
One of the goals of the EU bodies, particularly the European Central Bank (#ECB), for such an approach is to use “a policy tool that disincentivises investing in such assets from the outset and prevents the build-up of transition risk through crypto-assets in the banking system” until 2025.
As end-users of Bitcoin for fundraising and payment instruments, Open Dialogue Foundation concerns that such a policy would directly affect both us and the Bitcoin industry, which services we and other activists use. Especially because the European Commission wants to “collaborate internationally with different standardisation bodies to develop the energy-efficiency label” for PoW:
“States shall implement targeted and proportionate measures to lower, and must be ready to stop, the electricity consumption of crypto-asset miners, in line with the proposed Council Regulation on an emergency intervention to address high energy prices.”
We need to do educational advocacy - over 200 face to face meetings with MPs and regulators so they can learn and ask questions from bitcoin miners they never ask in public. Just as we did thanks to @npub1kp7…487l @npub1hyq…k7cp and @npub1sg6…f63m last years with #MiCA and #AML Regulations.
We need to be able to defend our rights to use Bitcoin in a legal way. So far it seems that the fight in the EU for Bitcoin is more important for activists than for bitcoiners, because everyone is excited about Bitcoin ETFs in the US, or believes that the market will solve the problem in the EU/move to other jurisdictions, or just doesn't believe in engaging with politicians to educate them. 😔
And I understand and respect all of that arguments, but we as human rights defenders have no place to move and we operate there, in the EU. 🙏

Narratives shape reality and perceptions, that is why we are teaching regulators and legislators about use of #bitcoin for human rights and humanitarian aid. We expose abusive practices of dictatorships to weaponize banking data and AML/CFT rules.
And we ask policymakers one simple question: can you provide for us another then bitcoin safe financial tool to operate in the authoritarian regimes for human rights activists excluded from the traditional banking system?
So far no other instruments provided.

Actually, we hope for changes at the end of December following the last election results.
I do believe that I would be not only allowed to comeback to #Poland, but hold accountable all those who used entirely state machinery against my family, me and my organization/volunteers/donors and supporters.
But once again: I would not be able to survive and continue my human rights work without #bitcoin. This technology not only saved me, but helped me to save many lives both in #Ukraine 🇺🇦 and in authoritarian states as #Kazakhstan, #Uzbekistan. That is why I initiated together with other activists BTC coalition to educate regulators and legislators in the OSCE region (57 countries, including North America, Europe and Asia) about the role of bitcoin for human rights and humanitarian aid.
