Remember when I told you that under the Trump administration financial surveillance would go up, and you all called me a FUDster?
The IRS now plans on sharing confidential tax information with ICE and DHS to carry out deportations.
This practice is *not* unprecedented:
The systemic use of tax information and financial records is one of the practices majorly credited with enabling H*tler’s mass deportations of Jews beginning in 1938, enabling the 'industrialization' of the Holocaust.
If you think this is fine because you are legally in the US, remember that Trump is currently attempting to deport and revoke a student’s green card for organizing protests at Columbia University.
Last week, the administration deported at least two Venezuelan asylum seekers legally in the US to El Salvador’s terrorist detention center, known for torture and inmate deaths. Neither had a criminal record – the basis for their deportation were allegedly misidentified tattoos.
If you think this is fine because you are a US citizen, remember that last week, the Treasury announced that it would lower the currency reporting threshold in 30 counties along the Mexican border from $10,000 down to $200 in attempts to fight gang activity – affecting anyone living in the area.
Over the past weeks, we have additionally seen a drastic increase in using deportations to prosecute political speech. Four days ago, a French space researcher was denied entry to the US for messages critical of Trump, which the administration allegedly described as ‘terrorism’.
This is the *second* major increase in financial surveillance in the US in the last two weeks.
If history has taught us anything, it should be that fascism does not stop at the people you don’t like.

From today, it is officially legal again for US persons to use Tornado Cash – But that doesn't mean that the Government's witch hunt on privacy services is over.
Announcing the reversal of sanctions, the Treasury Department issued a warning for US persons engaging with privacy services that may be used by North Korea.
According to Treasury Secretary Scott Bessent, "securing the digital asset industry from abuse by North Korea and other illicit actors is essential to establishing U.S. leadership and ensuring that the American people can benefit from financial innovation and inclusion."
The sanctions on Tornado Cash were lifted under the current interpretation of IEEPA, while the judges found that Congress may choose to amend the Act to cover sanctions against privacy software if it deems fit.

Today I criticized a friend on X for his reporting, and I was a bitch about it, so I think it may be time that I make something very clear.
I am a very nuanced person. When I criticize someone‘s work, I do not generalize my criticisms onto their *body of work* or onto their person.
I can disagree with something someone has done or said, or how someone has handled a situation, without discrediting what they have done in the past or will do in the future. My criticisms apply to what I criticize and to nothing above or beyond that.
Given the comments Ive received not just today but on previous criticisms ive voiced on other people/entities in this space - for example my criticisms of BPI’s EO draft - it seems that this nuance is not always clear to everyone.
Criticizing something a person has done does not make them a bad person, even less does it imply that *I* think that they are a bad person. Criticizing something and entity has done does not make the entity a bad entity, nor does it imply that *I* believe so.

Yesterday's first Digital Assets Subcommittee hearing has us down bad for privacy, my guys.
As stated by former CFTC Chair Timothy Massad, self-custodial wallets are the reason we are seeing digital assets used for sanctions evasion, money laundering and Hamas financing, with other witnesses piling on the lack of KYC.
Going purely on vibes, it seems plausible that we may see Congress attempt to rewrite IEEPA and US Code to apply KYC/AML/CFT requirements to self-custodial wallets and decentralized services as suggested by the Fifth Circuit's Tornado Cash sanctions reversal as well as Financial Action Task Force virtual asset guidance.

Tornado Cash sanctions reversal is not "irrelevant", says EFF, urging the court to directly dismiss the criminal charges against the Tornado Cash developer.
"If Congress wishes to pass a law that is intended to reach a tool like Tornado Cash, it can do so."
If the court does not wish to dismiss the case on grounds of the reversal of sanctions, it should dismiss the case on grounds of due process, says EFF:
Because the Government's argumentation is a too broad interpretation of the law, it runs the risk of criminalizing privacy software development as an expression of free speech.
The court "should clearly reject the implication that any tool that allows (or supports) people having 'enhanced anonymity' is inherently suspect."
The EFF additionally rejects the Government's argumentation that Storm attempted to profit from illicit activity:
"The argument is akin to claiming that Visa or MasterCard would be criminally liable based solely on receiving transaction fees whenever its customers transferred money as part of some underlying criminal activity."

Another day, another exchange I am suspended from.
All of my funds are conjoined or swapped between LN/XMR for privacy before sending to exchanges, triggering all sorts of nonsense AML flags.
The exchange I am with now is requesting proof of funds, meaning it wants to see fiat coming into my bank account from an entity I have a business relationship with, asking me to "kindly assist them" in surveilling me.
Except that all of my business relationships are handled in bitcoin – meaning that it is impossible for me to show proof of fiat funds.
Alternatively, the exchange says, I could send them “the address” to which I received payment in the last year, matching the amount of money I have exchanged on their platform.
Obviously no such address exists as I create a new address for each transaction (and so should you). Additionally, much of my money comes in through donations, for which I simply do not have an invoice.
I could now send them every single zap I ever received on nostr in the past year – for context, that would be over 250 zaps in the past week alone, s/o to all the zappers – or I could move my business to Switzerland, where I can exchange up to 1000 CHF per day KYC-free (for now), which is what I’m going to do.
However, since I’ll be more heavily relying on peer-to-peer exchanges from now on, I’ll likely have my bank account flagged for receiving weekly payments from randos on the internet, making it fairly foreseeable that I’ll be losing my bank account in the coming months as well.
Fundamental rights violations aside, the amount of complete nonsense work – and with that costs – this system creates both for the Government and private institutions is absolutely astonishing. If there ever was a true bullshit job, compliance officer would no doubt be it.
It’s time we end the global discrimination complex inherent to the financial system in which we are all guilty until proven innocent, only to upkeep an inefficient system that is useless in preventing crime but formidable for imposing mass surveillance on the people.
So no, I will not "kindly assist you" in surveilling me, and if I die on this hill.

Now that Fold App is going public, let's remember that the company partnered with PokemonGo developer Niantic, which was recently revealed to appropriate user data to train a geospatial AI that might be sold to "governments and militaries".
For context, Niantic was developed as an internal Google startup by John Hanke, who previously founded the CIA financed geospatial visualizer Keyhole, which would later turn into Google Earth and Google Maps.

So the Trump's 'crypto* EO is out, and I'm seeing lots of weak bitches cry that its a shitcoin reserve.
Given the fact that the proposed digital assets stockpile would possibly be built on *seized* coins, let me give you a quick introduction to forfeiture law, and why crying for daddy to please please make its pile of flying horseshit "bitcoin only" *literally* the most retarded thing you could be wishing for, ever.
Forfeiture law – or civil asset forfeiture, to be precise – is this fun little game the government plays in which it does not have to accuse you of a crime to confiscate your property.
Instead of accusing you of a crime, the Government claims that the asset itself has facilitated a crime, and can therefore be seized by the Government.
In civil asset forfeiture, there is no innocent until proven guilty. To get your property back, *you* have to prove that the Government is wrong – which turns out pretty complicated seeing how its impossible to prove a negative.
Civil asset forfeiture results in cases that are not filed against a person, but filed against the property itself. This results in fun little cases like US vs. Binance Account XYZ, or US vs. 123 Wilmington Drive.
To extend this idea to Bitcoin, in a civil forfeiture case, the US Government is in theory able to seize *any bitcoin* that has *ever* come out of a criminal transaction.
Made some bitcoin for selling a service? Bought some bitcoin on a P2P exchange? Unless you checked that the UTXO you received has never touched a criminal transaction in its entire history, your coins can be confiscated, and there's pretty much nothing you can do about it.
As Cato Institute points out in its piece on civil forfeiture reform, forfeiture law is routinely misused to enrich the Government – Philadelphia, for example, has seized over 1000 homes, over 3000 vehicles, and over $44M in cash over an 11 year period. In 2010, the city tried to seize *an entire fucking house* because a woman's grandson sold less than $200 of weed out of the basement.
If you think that taxes are bad, civil asset forfeiture is straight up evil.
It doesn't matter whether you participated in a crime. It doesn't matter whether you know that someone else participated in a crime. If it involved your property, even if said property was fully legally acquired, the Government will come and take it.

What about the Chainalysis sanctions oracle Tornado Cash implemented to block OFAC listed entities from accessing the service?
That's "window dressing," the Government says – an inefficient step that was only taken to "make a public announcement that TC wasn't violating the law." OK then.
The Government continues to appear to allege that the sole purpose of Tornado Cash was to enable criminal transactions, again making references to the prosecution of Silk Road operator Ross Ulbricht – ignoring the fact that while Silk Road operated as a dark net market, Tornado Cash illicit transactions are only estimated to have made up around 14% of overall activity be the Government's own calculations, primarily pertaining to funds originating from hacks.
What's worse is that the Government doubles down on charging the developers for the development of a User Interface, continuing to attempt to enforce FATF recommendation 66 against FinCEN guidance and despite the lack of official adoption.
This case is a complete abomination of the US justice system. Everyone working on its prosecution should be fired.

There's this notion in Bitcoin that we are building tools to help the world become a better place – but when faced with actual, real world problems, responses are often reactionary and self-serving.
Bitcoin isn't private enough? You're just not using the right tools. The tools are too complicated? You're just not dedicated enough to the cause. Bitcoin fixes all your problems, you just need to spend countless hours of your life to understanding it.
Yesterday, @nprofile…y264 released a report on the usability of Bitcoin (and privacy coins) for activists, and it's a sobering look at how builders in this space have failed those they claim to help protect.
No-KYC on- and off-ramps are still too hard to use. Coins need to be swapped between networks or privatized with dedicated software. Self-custody is easy, but wallets offering network-level protections are often not directed at non-technical users.
We can ignore these criticisms if we want. Or we can stop gaslighting users and skeptics alike for not being educated or engaged enough, and start dedicating more resources to building tools that actually serve the needs of those who need it most.

Some of you may have missed it, but there's a new Bitcoin Bill in town – this time in Oklahoma.
While room temperature IQ bros are busy lobbying for the federal government to buy bitcoin, Oklahoma member of the Senate Dusty Deevers introduced the Bitcoin Freedom Act that actually works to protect Bitcoin and its users from Government overreach.
Not only does the Bill formalize for merchants to accept bitcoin as payment – it also exempts non-custodial services from requiring money transmitter licenses and protects their operators from Bank Secrecy Act applications.
The Bitcoin Freedom Act "ensures that participation is entirely voluntary, respecting free-market principles and empowering employees, employers, and businesses to choose the payment options that work best for them."

I want to talk about something that some people may find offensive, and that I can’t talk about on Twitter to not get shadow banned as I have to rely on reach for my work.
The first time I attended Chaos Computer Congress was over 15 years ago. It had the best parties in town, and we would sneak in for the nightlife.
As I rekindled my interest in politics, computers and the internet, I became more aligned with the CCC’s mission: hacking the planet to hold power to account.
While I was already disappointed with some of the CCC’s policies – particularly on things like COVID and Bitcoin – this year was the first time that I seriously lost hope for and trust in the CCC as an institution – starting with its opening speech.
The CCC’s opening speech sets the theme for the event. This year, it was dedicated to the global rise of fascism. Speakers talked about Germany’s protests against the far-right AFD, about Donald Trump, LGBTQ and abortions, and pro-democracy protests in countries like Georgia.
But not a single word was lost to the genocide in Palestine.
Checking the CCC’s schedule, I merely found a single talk on Palestine, which explicitly made clear that it did not take a stance on whether Israel was right or wrong in its operations.
There were still a lot of great talks at the congress, and many assemblies showed their solidarity, but this complete lack of mention is what really stood out for me.
To understand what a hackers congress has to do with genocide, we need to take an uncomfortable look at Nazi Germany.
What enabled the Holocaust 80 years ago was not just a bunch of bloodthirsty eugenicist maniacs high on ungodly amounts of speed and their fascist ideologies. It was the streamlining of exploitation and murder to never before seen efficiency, with the help of new, more efficient technologies.
It is these same advancements in technology that are fueling the genocide in Palestine today. It’s surveillance on an unprecedented scale, evermore invasive spyware, AI enabled targeting and automated drone warfare.
You can think of Palestine what you want, but this technology is being exported from Palestine to the rest of the world today.
It’s facial recognition systems and license plate scanners that Israel uses to enforce apartheid that you’ll soon see scanning your biometrics for your next flight on holidays, or your car on your next trip to work.
It’s spyware companies that test their products to soon sell them to governments around the world targeting activists, journalists and opposition.
It’s psychological warfare utilizing dating sites like Grindr to social engineer Palestinians into spying on their peers and extort their sexual preferences.
Just last month, the a16z portfolio company Skydio, which is a major Israeli military contractor, was caught providing its surveillance drones to Yale University to monitor and track student protestors.
Some of you may find this topic uncomfortable as it may not align with your political views.
But the reality remains that the genocide in Palestine is a testing ground for never before seen surveillance tech that will soon be used on you. And the world’s most renowned hackers are silent.

Last week, the UN General Assembly adopted the UN Cybercrime Convention – a global treaty to formalize the cooperation of law enforcement agencies between UN member states, that officially voids bank secrecy laws.
Here's what this means for you:
When other countries want to access your financial information for law enforcement investigations, they currently have two primary methods to rely on.
First, there's information sharing via the Egmont Group: a global consortium of Financial Intelligence Units (FIUs), which allow countries to request financial data for anti-money laundering and counter-terrorist financing investigations from other FIUs. A similar program already exists within the UN, called goAML – a database to share financial information.
Data shared via the Egmont Group is highly confidential and for investigative purposes only, i.e. not allowed to be used in court.
To legally act on the information obtained, countries have mutual legal assistance treaties (MLATs), which require law enforcement agencies to cooperate with each other for example in the seizure of assets.
Under the UK-US MLAT, if the UK receives a request by the US to freeze or seize a person's assets due to a money laundering investigation, the UK is required to oblige by the US' requests, and vice-versa.
In contrast, for example, the UK currently does not have an MLAT with China. While both are parties to the UN, and some cooperation agreements for UN member states already exist, the UK may currently tell China to fuck off if it requests the seizure of assets held in the UK.
The UN Cybercrime Convention essentially functions as a UN-wide MLAT. The only prerequisite to the Convention is that the crime a country requests assistance in is also a crime in the country it requests assistance from.
With the UN's Cybercrime Convention, China, and any other UN member state, may now request other countries to freeze, seize, and forfeit assets on behalf of the requesting country – MLAT or not.
The Convention is now expected to be ratified by UN member states, and it's an absolute nightmare for the security of your funds, putting you at risk of asset seizures through authoritarian regimes – no matter what country you are in.

Good morning! It's January 3rd, which means its not your keys, not your coins day.
Unfortunately, this year the EU has decided to make withdrawing from exchanges a hell of a lot harder by extending FATF's Travel Rule to digital assets.
The FATF Travel Rule is not just a remarkable shitshow for your financial privacy and security – it's also a law to which authorities appear to have no data on its effectiveness to prevent financial crime.
What this means for you: If you want to withdraw funds exceeding €1.000, you'll need to prove that you own the address you are intending to withdraw to to your custodian.
It also means that exchanges are required to forward your personal information, including things like your name and address, to any custodian you are transacting with, and that an exchange may collect information on whom you are sending funds to and whom you are receiving funds from.
The Travel Rule does not just make withdrawing from exchanges harder, as custodians will need to employ third party software, employ a signing protocol like AOPP, or have you conduct a micro transaction to the custodian before making your transfer.
It also poses an incredible risk to your financial privacy and security, as your KYC info will not just be stored with a custodian you trust, but with any custodian you transact with – increasing the risks of hacks and identity theft.
In its current form, the Travel Rule has been mandatory in tradfi in the EU since 2012 – But nobody seems to know whether it actually works to prevent money laundering or not.
That's why I filed a FOIA request with German authorities last month, requesting data on all money laundering convictions in Germany since 2008.
Interestingly, the Ministry of the Interior responsible for national security and overseeing Germany's law enforcement, responded that it had no such information - instead asking me to file FOIA Requests with the German Ministry of Finance, the German Customs Authority, as well as with every public prosecutors office...
...which means that the updated Travel Rule is the extension of a law to whichs effectiveness law enforcement appears to have no data.

This is a nostr appreciation post to start the new year. I don’t think any of us are ready for how this thing can change the media.
No more algorithms doesn’t just mean that you get to control what you see – it also means that journalists like me can directly interact with their readers to get real feedback on how their content is perceived, without collecting anyones data.
Lots of posts of mine do terribly on Twitter but do very well on nostr – simply because the algorithm disfavors them for using a wrong word, format or hashtag. Other posts don’t do well on either – telling me that I need to get better at explaining things. Quality feedback like this is the holy grail for any journalist because it makes us better at what we do, and it’s impossible to achieve on the manipulation sites.
And for the zaps – it’s the only mechanism I have seen that actually discourages having a paywall. People *will* and *do* spend money on content they appreciate; not because they are forced to, but because they value what other people have created. This simply doesn’t work when what you make is hidden for a payment in advance scheme that requires you to setup an account and make new passwords for every page.
Journalists, just like artists, don't create stuff because they want to get rich (maybe some do, but that's a pretty stupid strategy). We create things because its physically impossible for us not to. Knowing that someone is willing to spend their sats on your work is the best feedback you can get.
