op return is "the least harmful" way to store this stuff for the reasons you cite, but it's also 4x more expensive (simplifying because it's less expensive if storing smaller amounts) - so plenty of the time OP RETURN is preferable for spammers *and* the network which is the supposed rationale for all this. Obviously taking all that in isolation is foolish, but that's the steel man.
