As for licensing: His blocklists for Mastodon, Pleroma etc. are provided under CC-BY-SA - so, he doesn't see them as a software issue, but as a COPYRIGHT issue.
Also, he says "This list is not comprehensive; to keep this list small, I excluded many really bad instances. I take into account not just severity, but also notoriety and likelihood of reaching/harming people on other instances". So according to him, we are the WORST of the fediverse.
