Florida seeks to overturn 15 years of legal precedent in order to expand the list of death penalty eligible crimes to crimes that aren't murders.
They feel that the old Supreme Court made that ruling and the current Supreme Court would not uphold it.
The Supreme Court's original ruling was based on the US Constitution's 8th Amendment from 1791 forbidding cruel and unusual punishments.
Guess 1791 wasn't originalist enough for them to deify, huh.
