In part, but the European Convention on Human Rights requires that when there is a question of punishment for a crime where laws of two different jurisdictions might apply, the general rule is that the more lenient of the two should be applied. Under Tito in Yugoslavia they had the death penality, but prison was max 20 or 25 years (i forget) at the time I was there, bosnian law was i believe max 40 years in prison but no death penalty.
