Yes you are right up to a point, but if you look at the actual case law, such as the recent Warhol case, the legal line is not quite "small or remixed sample fine, big or verbatim sample bad".

The Supreme Court have made clear that SUBSTITUTION is one of the key tests.

Everyone is entitled to earn a living. If what you're doing would substantially replace the business income of the original artist, it's infringing.

Even small bits can infringe if the ORIGINAL use might have been small.
