You keep mentioning if Apple wasn't free, and I'm not sure how that has any bearing on anything. We have no control over Apple, and the very nature of RSS means that anyone can make a free podcast player, not just Apple.
How would you propose we get around that outside of having the data for a feed inside of some sort of walled garden?
