" Alright "smartass", if you know so much, why don't you start drafting laws "I am not a public official, and I'm sure you're just trolling, but for fun I thought I'd giver it a try. Because honestly, what better way to express the changes I'd like to see than actually outline those changes.
I call it the "The Global Ethical IP Reform Act" (GEIRA)
The Preamble - In recognition of the need to balance innovation, creativity, global access, and ethical protection of intellectual property, the Global Ethical IP Reform Act (GEIRA) establishes a new global standard. This act dismantles abusive practices, liberates essential knowledge, and creates a sustainable framework for creators and inventors to thrive without enabling monopolistic or parasitic behavior.
Title I: Liberation of Abused and Deadweight IP
Section 101: Nullification of Troll-Held IP.
* Any intellectual property held by entities proven to engage in:
-- Non-practicing entity (NPE) litigation without product development;
-- Shell-company patent hoarding;
-- Frivolous lawsuits targeting innovation;
Or passive revenue extraction with no production intent, shall be revoked and immediately entered into the public domain.
Section 102: Inactivity Clause.
* Any patent or copyright unused (commercially or publicly) for more than 5 years becomes public domain.
* “Use” is defined as: active development, licensing for genuine use, or free public availability.
Title II: Ending Digital Segregation
Section 201: Geo-Restriction Ban
* All digital content providers, platforms, and IP holders are prohibited from:
-- Blocking, filtering, or redirecting access based on geographic location;
-- Price discriminating by country without a clear infrastructure cost basis.
Violations shall be penalized as a restriction on digital human rights.
Title III: Ethical Intellectual Property Protections
Section 301: Copyright Reform.
* Copyright is granted for:
-- 20 years from the date of publication for commercial works.
-- 10 years for non-commercial works.
* After expiration, works are automatically released into the public domain.
* Copyright is non-renewable.
Section 302: Patent Reform.
* Patents are granted for:
-- 10 years from the filling date.
-- No extensions or "evergreening" allowed.
* Patents must be licensed or actively implemented within 3 years, or they are nullified.
Section 303: Transparency and Accessibility.
* All copyrighted and patented works must be:
-- Registered in a global open-access registry.
-- Marked clearly with expiration dates and usage rights.
Title IV: Creator Support and Innovation Funding.
Section 401: Public Innovation Funds.
* Governments and NGOs shall establish open grant systems to support:
-- Artists, inventors, researchers, and developers.
-- Open-source and public domain projects.
Section 402: Alternative Revenue Models.
* Global encouragement and support of:
-- Crowdfunding platforms.
-- Micro-royalty systems.
-- Subscription-based patronage (e.g., Patreon-style models).
-- Blockchain-certified licensing with smart contracts.
Title V: Enforcement and Oversight
Section 501: IP Abuse Tribunal
* A global tribunal will be established to:
-- Investigate and adjudicate allegations of trolling.
-- Enforce the geo-restriction ban.
-- Revoke IP rights found to be abused.
In conclusion, "The Global Ethical IP Reform Act" (GEIRA) represents a new contract between creators, users, and societies. It honors innovation while freeing knowledge. Furthermore, it ends exploitation while fostering creativity. Ultimately, designing a system for a fairer, more connected, and more inspired world.
My concept idea may not be perfect, because again, I'm not someone who drafts laws, but honestly, I think we already have worse today, and this would be a good outline to a better world.
