Would be great if they had to drop the whole case as "fruit of the poison tree." This means any evidence cops would not have had or known about in the absence of an illegal seach cannot be used no matter how the exact item came to the cops.
In this case, spotting Luigi at all is the fruit of the poison tree if searching the McDonald's was in any way illegal.
