The problem, I think, is that too many attorneys don't know what they don't know. Design patent law still isn't widely taught in law schools. Attorneys who are well-versed in related areas (utility patents, trademarks, copyright) seem to make assumptions about design patent law without stopping to ask things like: Is the test different here? Does this phrase mean something different here?
