I find it acceptable to use the cry-laugh emoji in a self deprecating manner to indicate "This sucks, but it's darkly funny so you can laugh."
Also, not offensive when used in response to a friend making a joke that is really funny.
I think it's less of a case that the emoji has inherently offensive intent and more the case that's it's just obtusely overused. Most people who are in-tune with society will understand how cliche it's become and avoid it like the plague. 😂 (intentional double foul)
That leaves it almost entirely to those who don't get things and are unable or unwilling to understand other people.
