When people say “this case should have never been brought” they are talking about prosecutorial discretion. And yeah, it’s a helluva a power. But it is a reality of our current system and affects thousands of defendants everyday. If you don’t like it - then fix the system for everyone; there is nothing special about defendants with the last name of Trump or Biden.
