The São Paulo Consumer Protection Office (Procon-SP) has launched a formal investigation against Uber and 99, alleging that the companies have been offering irregular taxi services in São Paulo without proper regulation by the city government and in defiance of a court order issued by the São Paulo State Court (TJ-SP). On the 16th, a judge suspended the service, imposing a daily fine of R$ 30,000. Despite this, the service continued to be offered by the platforms. On the 24th, a fatal accident involving a 99 taxi and another car resulted in the death of 23-year-old Larissa Barros Máximo Torres, a passenger in the taxi. According to the São Paulo Public Security Secretariat, Larissa was hit by the door of a car that was opened by one of its occupants. The taxi driver and the young woman were traveling on the motorcycle lane and were thrown onto the road, and the passenger was run over by another vehicle. After the incident, the court again suspended the service on the 26th. According to Procon-SP, Uber claimed in its response to the consumer protection agency's request for explanations that it was waiting for the outcome of its appeals, which, in the agency's view, did not justify continuing to offer the service after the court's prohibition. 'The activity should have been suspended pending the outcome of the prohibition, as in any other suspensive decision. Moreover, the companies will also be investigated for failure to provide the service, as by maintaining the activity, they assumed risks and their consequences also in the administrative sphere,' said Procon-SP in a statement. Uber and 99 are liable for fines of over R$ 13 million at Procon-SP. In a statement, 99Moto said it operated legally, backed by federal law and a first-instance court ruling that denied the city government's right to prohibit the service. 'After clarification with the order of interruption issued by Judge Eduardo Gouvêa, the company temporarily suspended the service,' the company said. 99Moto also requested urgency in obtaining a definitive decision from the TJ-SP on the unconstitutionality of the city government's prohibition decree. Uber stated that it temporarily suspended the Uber Moto service in São Paulo, in accordance with the judicial decision, 'while waiting for the analysis of the matter by the competent authorities, either through regulation or definitive judicial decision.'
