But I already know that many courts have made the decision based on the argument. The fact that the argument is successful does not necessarily make it a good one.

We've seen many a populist and inhuman argument which is absolutely terrible, and yet has succeeded through a combination of the three judicial factors most well-known among the rich - grift, thrift, and swift.
(Or bribery, sloth, and expedience, if you prefer.)
This is one more step towards a place where parental rights are the sole and singular argument against the rights of the child. And we have seen that increasing over the last few years. It's not in full bloom yet, but the flowers are sprouting.
