So this would be an issue if we used something like OP_Return instead. Let's say I made 5 transactions, hashed them just like you would in CTV but drop the hash into an op_return. You'd be absolutely right that I could doublespend the transaction because nothing is actually committing those tx's to the chain except my promise to not doublespend as it's still my private key connected to that pubkey. But with CTV, there is no private key, it's just that hash. So I can't doublespend, only those legitimate transactions can extract their portion of the UTXO can do it. When I commit my 1 CTV tx to the chain, even though those 5 tx's aren't "on the on-chain", they are still protected by consensus. Lightning does it in a similar way, those tx's aren't on chain but theyre still protected by consensus.
