The air is not excludable. If I add CO2 to the air, by its it nature it will diffuse into everyone's air. Land, however, is excludable. Land with desirable features, however, is rare and excludable. If one person or enterprise is creating value there, someone else is not. So you need some system to determine whose it is. If air were like that, we could buy it, cleaner it up or trash it, and it would be no one else's business because it's our property.
