Judge Seeger issued a 13 page order refusing to dismiss one defendant from a Schedule A case because he thinks Rule 41 does not allow Plaintiffs to drop one settling Defendant from a case even though most other Judges do allow it for efficiency. He calls for Rule 41 to be updated to reflect how it is used (but how he won't use it here!).
