Neither of your two arguments are considering the fact that copyright has nothing to do about *process*, it has to do about *works*. Just because a *process* exists that is technically similar to another *process* that produces a derivative work doesn't mean that the former also does, because it's noth about process similarity, it's about the nature of the work.
We're clearly getting nowhere with this conversation so I will not be replying further, as you don't seem to be listening and you're applying bogus arguments of *technical* similarity to a *legal* question.
