Completely agree with you about whether to prosecute or not. If you don't, you're not damaging the rule of law, you're admitting there is no rule of law.
That said, shouldn't DOJ vigorously argue for a different judge? Has a former governor ever been tried before a judge they appointed? The optics are so bad, and the consequences so dire, it seems like the responsible thing to do is at least make the argument that literally any other judge should preside.
