In a significant ruling earlier this evening, the U.S. Court of International Trade determined in two separate cases that President Donald J. Trump lacks the authority under the International Emergency Economic Powers Act of 1977 (IEEPA) to unilaterally impose broad tariffs on much of the global economy. This includes, but is not limited to, the "Liberation Day" tariffs he announced in early April. The Court affirmed that the U.S. Constitution grants Congress exclusive power to regulate international commerce — a power not superseded by the president's emergency authorities. As a result, all tariffs and executive orders related to tariffs issued by President Trump under the IEEPA since January have been immediately invalidated.
