Because that's not how copyright works. You seem to wish it worked that way, maybe it would make some sense for it to work that way under limited situations. But it doesn't.
We're arguing in circles here, so unless you bring some evidence that your completely unconventional interpretation of copyright law actually has prior court interpretation art, I'm just going to stop replying now.
BTW, I don't "defend" SaaS. I merely assert that protecting against SaaS requires going outside the Free Software Definition. I fully endorse people who want to ban SaaS usage without source offers. They just can't call their software Free Software by conventional definitions.
