On one hand, yeah, that would lead to a non-compliant implementation.
On the other, generative AI *is* a new area that creates new considerations. I was there, in the European Parliament, talking to MEPs, when the Copyright Directive was being passed. Generative AI was not on anybody's radar.
TDM meant things like collating databases and figuring out stuff based on that (science, investigative journalism, etc), not the dumpster fire of genAI.
