No, Batman should not kill the Joker. Extrajudicial killings aren't what superheroism is about, and it's not Batman's job to be an executioner.
That said, the district of Gotham should have put the Joker's laughing ass to death decades ago, and in anything like the real world they *would* have done, assuming he didn't die in a hail of police bullets during one of his puerile practical jokes.
