I don't think so. Legality has nothing to do with it. That can make is worse actually. More important is to build free (as in freedom) alternatives.
Baning stuff is in the state toolkit and baning other capitalists will make you the Mister Monopoly. That's what happened in Bulgaria (and probably every counry from the Eastern Bloc) after 1945.
