submodules avoid licensing issues with becoming a distributor of potentially restrictively licensed code.
git is not an archival tool, its for versioning currently maintained projects. not really the fault of git you can't download the submodules.
I do agree that there should be a better alternative to submodules for certain applications though (like freezing dependencies). Maybe I should try subversion though.
