The concept of a "design patent" seems contradictory to me. A design should be protected under copyright as it's fundamentally different from an invention in that it's not a new thing but an arrangement of existing things. (cf Steve Job's staircase patent!)
I discussed this with a Silicon Valley patent lawyer some years ago and he basically agreed but said the law allows it so that's what happens.
