I agree with all that.

However, the point of judge's opinion is not to win over the "defeated" party by force of reason, but to win over the majority of those in the community by force of reason (especially the majority of those capable of taking arms).

The idea (from my perspective) is that the judge convinces more or less everyone that a certain situation should be handled in a certain way, and thanks to this consensus the "defeated" party is obliged to acquiesce.

Right now, State officials are able to implement arbitrary regulations and taxes because the public is resigned to it, and the public sees these measures as representative of a consensus that they cannot personally oppose even if it is somehow unjust. As dictatorial "law" progresses that consensus unravels.
