They're not putting him in jail pre-trial because, while most appeals can only happen after a final judgment, one of the few exceptions is orders of pretrial detention. In other words, if she puts him in jail, everything stops while he appeals first to a higher court and then to the Supreme Court. The chances of having him tried before the election would plummet, which is not something the judge should worry about for political reasons but definitely is something she should worry about in the interest of speedy administration of justice.
