Sure, but it can be turned on, and there are a lot of types of coercive power relationships that will mean it *does* get turned on.
Even if the people being surveilled don't want it to be on.
Even if the people doing the coercing shouldn't be doing that.
Guarding against all those situations is really, really hard.
