This OpenAI vs NYT thing is going to demonstrate whether or not the "locus of control" with regard to actual power in this country has fully shifted from New York and the east coast, to San Francisco / Seattle and the west coast, (or not).
I doubt there is a way to decide the issue "on the merits", because it is so subjective, especially when you incorporate the concept of "fair use".
