The court essentially just wrote legislation defining gender as gender assigned at birth, and in a legal sense they invented that wholecloth and inserted it into law. That did not exist in the law they were "interpreting", and was counter to how those who studied the law and it's history understood the law. Simply put, there is no reasonable way to believe that this remarkably specific piece of far right rhetoric that makes no sense under scrutiny was something existing within this law, and the court invented the idea that it could be assumed.
