Actually, I still don't think it is consistent. The judge can say that legal sex, not actual sex is the basis of his ruling, but to use that to discard Grover's reason of banning tickle does not make sense, as it is not a truthful statement any more to say the banning is purely based on appearance. He could say it is based on the irrelevant belief of grover that tickle is male.
