RFK Jr is correct about holding corporations accountable for externalized costs of pollution from the production of their products. For example, former Pennsylvania coal mining practices leading to destruction of property and waterways, and environmental destruction from fracking.
However, his solution is to use the hand of central government's power of force, taxation and regulation. This is a fascist solution, where an anarchic solution is equally available. Rothbard addressed this problem extensively in his books defining anarcho-capitalism.
The freest, non-fascist solution is to remove exisisting environmental laws that shield companies from liability from pollution. Rather than changing the terms under which the government guarantees its liability protection, one could return property rights of land holders to everything on, in and above their land. This enables them to (individually or collectively) sue anyone that impairs the use of or destroys their property from outsiders polluting or witholding water rights to natural flowages, polluting the air or stealing the resources in their ground without just compensation. The same applies to the airwaves. Excessive and harmful EM radiation that can be shown to cause harm (possibly from megawatt TV and FM towers and focused microwave beams) under this system would immediately be minimized to healthy levels.
This philosophy limits corporations' liability to that which they actually pollute and cause harm, and that which actually causes damage to its neighbors' property, rather than RFK Jr.'s present abstract and reactionary threat to "force" them to internalize their costs through better regulation. He does nothing to address regulatory capture, something that is inevitable in a fascist system. Under the Rothbardian prescription, one only need remove existing laws and perfect the function of justice.
