I've seen that actually happen in court. Guy accused of drug dealing was told to hand over his crypto. He said he couldn't because he wrote down the private keys, hid them in a golf club then forgot about it and sold the golf clubs. Prosecution couldn't prove he had access to the crypto so the judge accepted it and they had to move on.
