Don't know. From my point of view, as long as it's within's arms reach (eg. under your seat), it should be fine. On the rack above, not sure, this would have to be argued in front of a judge to be sure… But this can be used to argue with SNCF employees, that the rack above your head is at your reach, so not subject to this law.
