I don’t think there is an objective way to know for certain that it’s unspendable. Maybe there could be a way to purposefully label it as such so that nodes explicitly refuse to allow it, but I feel like that would have to be a soft fork possibly just because it means nodes treat potentially valid transactions very differently. But something like this could maybe allow the witness data problem to no longer be a contributor to the UTXO problem.

The big issue in my opinion is the direction of development and culture around this issue. Rather than thinking of it like a problem, the conversation is about accommodating it. And, in my opinion, it should be treated explicitly and unambiguously as if it is a problem. Same as dog shit in the park isn’t the end of the world, but that doesn’t mean we encourage it, imo.
