You're assuming there would be such a consortium. I clearly just outlined a scenario where such a consortium would not exist. Most / all OEMs would sign the NDA with Google for access to the OS. It would be similar to how PC manufacturers work with Microsoft & Windows.
In this world your project would cease to exist.
