It also openly waters down the recusal rules for dubious reasons. They say "The absence of one Justice risks the affirmance of a lower court decision by an evenly divided Court, potentially preventing the Court from providing a uniform national rule of decision on an important issue".

We might miss a uniform national rule, but the alternative in the given scenario is a uniform rule effectively coming from a justice with an apparent conflict of interest. That's *worse*.
