On one hand, saying "there's CSAM on the fediverse" is like saying "there's CSAM on message boards". Sure? Software is software, the authors can't control how people use it.
On the other, if you have not defederated from *every* instance where CSAM might be posted, your server might be caching and serving images that are illegal. This is a serious legal challenge *for you* (and your users) and you could be raided by law enforcement.
