A fair point regarding the legal issues.
But it is also hard to believe that presumably sophisticated "investors" / collectors buying at a Sotheby's auction believed there was any reason to think that glorified jpegs of Bored Apes would have been worth an "average price of over $241,000" at the time they bought them. This isn't a case where, for example, Sotheby's knowingly auctioned forged paintings.
The courts (or negotiations between the lawyers) will decide, of course.
