It could not be by state. So many people would be on the "wrong side" the same situation would persist. By county, maybe it could work.
I really think we need a global political structure that's more localized, somehow, that allows all people of the entire world to control things locally but with protections for all travelers passing through. I don't expect it in the next 25 years, but I think it's closer than it looks.
