If delta would refuse to do so, it could probably be forced to pay fines or be taken out of appstores; fines are not easy, because it isn't clear who is the responsible person/company.
For mail providers, the situation doesn't change.
It's exceptionally stupid because it's so easy to circumvent by perpetrators.
